MyoVision dynamic SEMG technology was credited by plaintiff's attorneys and his treating chiropractor as instrumental in winning the claimant a $650,000 award for soft tissue injuries in a case heard in Grant County, Washington in June, 2003. The verdict/award is currently under appeal. Washington attorneys Garth Dano and William Gilbert represented the plaintiff in his personal injury suit. According to attorney William Gilbert, "The MyoVision dynamic surface EMG and personal assistance of David Marcarian were significant and instrumental in the presentation of our case."
Treating chiropractor William Davis, DC, owner of Davis Chiropractic Clinic in Ephrata, Washington, had these comments about the case: "Juries have difficulty with soft tissue injury determination. Without objective evidence, these injuries just don't exist. MyoVision allowed us to show the jury muscle dysfunction 'just like an EKG of the spine.' The graphs were understandable to them and just what they were waiting to see."
This case was significant because the claimant's injuries from a low speed MVA interrupted a very lucrative career. Attorneys throughout the area quickly noted the details of the case, the high award, and the impact the MyoVision technology had on the final outcome. According to Dr. Davis, "If you're focusing on PI and you don't have this equipment in your office, you may want to rethink your emphasis. You need to protect your patients' rights in a court of law."
"This case represents another legal success story for MyoVision," says David Marcarian, designer of the MyoVision and President of Precision Biometrics in San Carlos, California. "More and more, MyoVision is helping win cases for both personal injury and workers' compensation claimants. And that's because it provides the objective findings that cannot be produced by exams, x-rays, MRIs, and the other tools doctors have traditionally used to evaluate patients. We are very pleased by this recent success using our technology." For more information contact David Marcarian at 800-969-6961.
