Now that the dust has settled, Chiropractors around the country can celebrate another major win by David Marcarian, MA, president of MyoVision and expert witness credited with winning one of the largest PI jury awards in U.S. history. The case, Richard W. Merritt, DC vs. State of Florida, Department of Health (DOH) won by Marcarian in 2005 was appealed and made it to the Superior Court of Florida.
Again, the State was joined by a majority of the major insurance companies in a second round of "David vs. Goliath" court battles, and again Marcarian was victorious in the trial earlier this year. "I consider it a win for both insurers and health care providers, as this case proves that the device I invented can be used to show whether someone is injured as well as whether they are a symptom magnifier. By making patient management decisions based upon objective data, both insurers and chiropractors win" said Marcarian.
